Terms of Service
These Terms of Service ("Terms") govern your use of the LST Vita software and related services provided by LoneStar Tracking, LLC ("Company," "we," "us," or "our"). By using LST Vita, you agree to these Terms. If you do not agree, you may not use our services.
1. Services Provided
LST Vita is a monitoring platform designed to display and analyze data from supported devices such as temperature sensors and gateways. While we strive to provide a reliable service, we make no guarantees regarding the accuracy, completeness, or availability of the data provided.
2. No Guarantee of Accuracy or Uptime
- Monitoring data, graphs, and alerts are provided "as is" and "as available."
- We do not guarantee that the system will be error-free, uninterrupted, or that alerts will always be delivered.
- Factors outside of our control—including but not limited to power outages, internet connectivity, wireless interference, third-party service disruptions, or device malfunctions—may prevent delivery of alerts.
3. Limitation of Liability
By using LST Vita, you expressly agree that:
- LoneStar Tracking, LLC and LST Vita shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
- This includes, but is not limited to, damages resulting from missed alerts, inaccurate data, service outages, or device failures.
- You agree to hold LoneStar Tracking, LLC and LST Vita harmless from any claims, demands, or damages of any kind resulting from your use or inability to use the services.
4. User Responsibilities
- You are responsible for ensuring your devices are installed, powered, and maintained according to instructions.
- You are responsible for providing reliable internet connectivity and monitoring alerts.
- LST Vita should not be relied upon as your sole safety or compliance system.
5. Warranty
Hardware devices, such as sensors and gateways, are covered separately under our 1-Year Limited Warranty. Please refer to our Warranty Policy for details.
6. Termination
We reserve the right to suspend or terminate your access to LST Vita at any time, without notice, for conduct that violates these Terms or is otherwise harmful to the service.
7. Changes to Terms
We may update these Terms at any time. Updated Terms will be posted on our website, and continued use of LST Vita constitutes acceptance of the revised Terms.
8. Governing Law
These Terms are governed by and construed under the laws of the State of Texas, without regard to its conflict of law provisions.
